WILL be received and opened publicly at the office of Cole County Commission, Courthouse Annex, Room 200, 311 East High Street, Jefferson City, Missouri 65101 at 9:00 A.M. on Wednesday, March 15, 2023.
Any and all bids received after the time specified above will be returned unopened.
The proposed work consists of grading, excavating, railroad tracks, roadways, drainage
structures, utilities, erosion control, seeding and mulching, and other miscellaneous work
necessary to construct the proposed railroad spur extension and trans-load facility in
Jefferson City, Missouri.

A pre-bid conference will be held on Wednesday March 1, 2023 at 9:00 AM at the office
of the Cole County Commission, Courthouse Annex, Room 200, 311 East High Street,
Jefferson City, Missouri 65101. All bidders are urged to attend.
BID SECURITY: A certified check on a solvent bank or a bid bond by a satisfactory surety
in an amount to five percent (5%) of the total amount of the bid must accompany each
proposal.
WAGE RATES: All wages paid for work under this contract shall comply with
requirements of the federal Davis-Bacon Act (40 U.S.C. Sec. 3141 et seq. & 29 C.F.R.
part 5), and the prevailing wage law of the State of Missouri, Section 290.210 through
290.340, RSMo. 1986.
NONDISCRIMINATION IN EMPLOYMENT: Bidders on this work will be required to
comply with the President’s Executive Order Number 11246 and 41 CFR Part 60-4.
Requirements for bidders and contractors under this order are explained in the
specifications.
WORKER ELIGIBILITY: Execution of the construction contract for this project is
dependent upon the awarded bidder providing an E-Verify Memorandum-of-
Understanding (MOU) between the bidder and Department of Homeland Security to the
Contracting Authority as required by section 285.530 RSMo.
ANTI-LOBBYING ACT: Sub recipients who request or receive from the grant recipient a
subgrant, contract, or subcontract exceeding $100,000, at any tier under a federal grant
shall comply with the anti-lobbying certification requirements under 15 CFR Part 28, “New
Restrictions on Lobbying.”
This project will be partially funded with Federal funds from the United States Department
of Commerce, Economic Development Administration and therefore is subject to the
Federal laws and regulations associated with that program.
The Owner reserves the right to reject any and all bids and to waive informalities therein.
The bid will be awarded to the lowest, responsive, responsible bidder, who’s bid conforms
with all the material terms and conditions of the Instructions to Bidders. E.O.E.
